Terms of Use

These Terms of Use (“Terms”) govern your use of the Polson app (“Polson”, “the app”), provided by Ricky Chopra (“we”, “us”). By downloading or using Polson, you agree to these Terms. If you do not agree, do not use the app. Contact: support@polson.app.
1. The service
Polson is a mental-fitness app of games and challenges. We may add, change, or remove features and content over time.
2. Your account
You sign in with Apple. You are responsible for activity under your account. You must be old enough to form a binding contract in your country to make purchases.
3. Free use and purchases
- Free tier: you can play one circuit per day at no cost.
- Packs: additional content and unlimited play are available as one-time purchases through Apple’s In-App Purchase. There is no subscription.
- All payments are processed by Apple under Apple’s terms; we never receive your payment details.
- Refunds for purchases are handled by Apple in accordance with Apple’s policies. Requests should be made to Apple.
- Purchases are tied to your Apple ID. Deleting your Polson account does not refund purchases.
4. Licence
We grant you a personal, limited, non-exclusive, non-transferable, revocable licence to use Polson for your own personal, non-commercial use, subject to these Terms and to Apple’s Licensed Application End User License Agreement.
5. Acceptable use
You agree not to: copy, modify, reverse-engineer, or resell the app or its content; use it unlawfully; or attempt to disrupt or gain unauthorised access to the service.
6. Intellectual property
The app, its games, content, and branding are owned by us or our licensors and are protected by law. These Terms do not transfer any ownership to you.
7. Not medical or health advice
Polson is for training and entertainment. It is not a medical device and does not provide medical, psychological, or health advice, diagnosis, or treatment. Do not rely on it for any health decision.
8. Disclaimers
The app is provided “as is” and “as available”, without warranties of any kind to the fullest extent permitted by law. We do not warrant that the app will be uninterrupted, error-free, or that data will always be preserved.
9. Limitation of liability
To the fullest extent permitted by law, we will not be liable for any indirect, incidental, or consequential damages, or for loss of data or profits, arising from your use of the app. Nothing in these Terms excludes liability that cannot be excluded by law.
10. Termination
You may stop using the app and delete your account at any time (Account → Delete account). We may suspend or terminate access if you breach these Terms.
11. Changes
We may update these Terms. Continued use after an update means you accept the revised Terms.
12. Governing law
These Terms are governed by the laws of England and Wales, without regard to conflict-of-laws rules.
13. Apple-specific terms
Because Polson is distributed via Apple’s App Store, the following apply:
- These Terms are between you and us only, not with Apple. Apple is not responsible for the app or its content.
- Your licence to use Polson is limited to a non-transferable licence to use it on Apple-branded devices you own or control, as permitted by the App Store Terms of Service.
- Maintenance and support for the app is our responsibility, not Apple’s.
- To the extent permitted by law, Apple has no warranty obligation for the app. If the app fails to conform to any applicable warranty, you may notify Apple and Apple may refund the purchase price (if any); Apple has no other warranty obligation.
- We, not Apple, are responsible for addressing any claims relating to the app, including product-liability, legal or regulatory non-compliance, and consumer-protection claims.
- We, not Apple, are responsible for investigating and resolving any third-party claim that the app infringes intellectual-property rights.
- You represent that you are not located in a country subject to a U.S. Government embargo or designated as “terrorist supporting”, and are not on any U.S. Government prohibited-parties list.
- Apple and Apple’s subsidiaries are third-party beneficiaries of these Terms and, upon your acceptance, have the right to enforce them against you.
